Our Promise
At PHAT Disruption, our commitment is to deliver the highest standard of care and support in every Group Fitness session. Your health, fitness, and wellbeing goals are at the heart of everything we do.
We promise to give our absolute best each time you train with us. If at any point you feel we are not meeting this standard, please share your feedback immediately so we can raise the bar.
Every session is carefully planned and structured to align with the goals of the group. While it may not always be possible to meet every individual preference, we are dedicated to ensuring each participant feels supported, safe, and appropriately challenged.
Booking a session via the Group Fitness Booking System is your acknowledgment that you have read and accept the risks, terms, and conditions outlined in this agreement. If you have any concerns, please contact us via email.

2. Fitness Waiver and Release
By booking and participating in any PHAT Disruption session, you acknowledge and accept the following:
2.1 Rules & Responsibility
I agree to abide by the rules of PHAT Disruption.
I am responsible for any damage to equipment caused by my negligence.
2.2 Waiver & Release
I HEREBY WAIVE AND RELEASE, indemnify, hold harmless, and forever discharge PHAT Disruption and its agents, employees, officers, directors, affiliates, successors, and assigns, coaches, teachers, and trustees from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities of every kind or nature, whether known or unknown, in law or equity, that I ever had or may have arising from or in any way related to my participation in any of the events or activities conducted by, on the premises of, or for the benefit of PHAT Disruption, provided that this waiver of liability does not apply to any acts of gross negligence or intentional, willful, or wanton misconduct.
2.3 Acknowledgement of Risk
I understand that the activities in which I will participate are inherently dangerous and may cause serious or grievous injury, including bodily injury, damage to personal property, and/or death.
On behalf of myself, my heirs, assigns, administrators, executors, and next of kin, I waive all claims for damages, injuries, or death sustained by me or my property arising from such activities, including claims in tort, contract, equity, or otherwise.
I accept these risks voluntarily and take full responsibility for my participation.
2.4 Health & Condition
I acknowledge, agree, and represent that I understand the nature of PHAT Disruption activities, that I am in good health, and that I am in proper physical condition to participate in such activities.
I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue participation in the activity.
2.5 Scope
By this Waiver, I assume all risks and take full responsibility for any personal injury, death, damage, or loss of personal property associated with PHAT Disruption, including but not limited to use of the facility and its equipment in any manner and participation in Group Fitness, Personal Training, Small Group Training, Online Training, events, or other related activities on or off the premises.
2.6 Entire Agreement
This WAIVER AND RELEASE contains the entire agreement between the parties and supersedes any prior written or oral agreements concerning its subject matter.
The provisions of this WAIVER AND RELEASE may be waived, altered, amended, or repealed, in whole or in part, only with the prior written consent of all parties.
2.7 Continuation
The provisions of this WAIVER AND RELEASE will continue in full force and effect even after termination of the activities conducted by, on the premises of, or for the benefit of PHAT Disruption, whether by agreement, operation of law, or otherwise.
2.8 Acknowledgement
I have read, understood, and fully agree to the terms of this WAIVER AND RELEASE.
I understand and confirm that by acknowledging and accepting this WAIVER AND RELEASE via the Group Fitness Booking System, I have given up considerable future legal rights.
3. Trainer-Client Agreement
3.1 New Client Consultation & Induction
All new clients must complete a mandatory consultation and induction prior to their first session.
During the consultation, clients will be asked to complete a Medical Pre-Exercise Screening Form. Based on responses, clients with certain medical conditions or risk factors may be required to provide a Medical Clearance Certificate from an appropriately qualified medical practitioner (e.g., GP or allied health practitioner) before commencing or continuing certain exercise programs.
If medical clearance is delayed, withheld, or limited, participation may be postponed or restricted to low-intensity or modified training until clearance is obtained.
This process ensures training is safe and appropriate to individual needs and supports our obligations under insurance, duty of care, and applicable professional standards.
All medical and health information will be handled confidentially and in compliance with privacy legislation.
3.2 Payment Processing
All sessions must be booked through the Group Fitness Booking System.
Payment is required in full at the time of booking. Payments are processed via our secure third-party provider, Stripe Payment Processing.
Coupon codes must be entered in the designated coupon field at the time of payment.
Please ensure you read and understand the Cancellation Policy below before booking.
3.3 Cancellation Policy — Reschedules, Credits, and Refunds
3.3.1 Reschedules
You may reschedule a session up to 6 hours before your session start time (subject to availability).
Reschedules can be completed via your session confirmation email or by logging into the booking system using your registered email address and password.
A new confirmation email will be sent to you after you have rescheduled your session.
If your preferred session is unavailable:
Provide at least 6 hours’ notice via email to request either:
A credit toward a future session; or
A refund (processed within 5–10 business days).
3.3.2 No Shows or Late Cancellations
If you do not attend your booked session, or you cancel less than 6 hours before your session start time, a reschedule, credit, or refund will not be granted.
Exceptional circumstances:
Medical or emergency situations will be assessed on a case-by-case basis at the discretion of PHAT Disruption Coaches. Possible outcomes may include:
Reschedule to a future session (subject to availability);
Credit if rescheduling is unavailable;
Refund (processed within 5–10 business days).
Refunds are not automatic and must be requested via email.
If PHAT Disruption cancels a session, you may reschedule, receive a credit, or request a full refund.
Refunds are provided only as required under Australian Consumer Law.
3.4 Pricing Policy
PHAT Disruption may review and adjust pricing at any time.
Clients will receive 14 days’ notice prior to any price changes.
Continuing to attend sessions after the effective date constitutes acceptance of the new pricing.
3.5 Age Policy
Clients must be 18 years of age or older.
Clients under the age of 18 years may participate with written consent from a parent or legal guardian. The parent or guardian must remain onsite during training sessions or ensure another responsible adult is present in the home/gym at all times.
3.6 Photography & Videography
Sessions may be photographed or filmed for promotional purposes.
Clients who do not wish to be recorded must notify their coach before the session begins.
3.7 Temporary Closures & Complimentary Sessions
Occasional closures may occur due to staff leave, charity work, or unforeseen events (e.g., weather).
Complimentary sessions may be offered where appropriate.
3.8 Group Fitness Schedule
The schedule is generally consistent but may change due to coach availability or unforeseen events (e.g., weather).
Schedule changes will be communicated as soon as possible via the Client Community Facebook group and weekly Chew the PHAT newsletter.
3.9 Wet Weather Safety Protocol
“Slippery When Wet” signage will be displayed at 7 Amber Court entrance/exit.
Clients are responsible for following all safety procedures to ensure their own safety and that of others.
3.10 Referral Reward Scheme
When an existing client refers a contact to PHAT Disruption Group Fitness:
The referred contact will receive their first session free by entering the coupon code FIRSTTIMEFREE at the payment screen of the Group Fitness Booking System.
The referring client will receive one free Group Fitness session once the referred contact completes their first paid booking.
Your coach will provide the applicable coupon code once eligibility is confirmed.
Limit one free session per new client referred. Offer is not transferable or redeemable for cash. PHAT Disruption reserves the right to amend or withdraw this offer at any time.
3.11 Client Acknowledgement
By booking a session, you acknowledge that you have:
Read, understood, and agreed to all terms outlined in the Fitness Waiver and Release and Trainer–Client Agreement.
Agreed to assume responsibility for your health, safety, and participation.
