OUR PROMISE, FITNESS WAIVER AND RELEASE, AND TRAINER CLIENT AGREEMENT

Our Promise

At PHAT Disruption, our commitment is to deliver the highest standard of care and support in every Group Fitness session. Your health, fitness, and wellbeing goals are at the heart of everything we do.

We promise to give our absolute best each time you train with us. If at any point you feel we are not meeting this standard, we encourage you to share your feedback immediately so we can raise the bar and go above and beyond your expectations.

Every session is carefully planned and structured to align with the goals of the group. While it may not always be possible to meet every individual preference in a group environment, we are dedicated to ensuring each participant feels supported, safe, and challenged appropriately.

Booking a Group Fitness session via our platform https://phatdisruptionGFbookingsystem.as.me/ is your acknowledgement and acceptance of the risks, terms and conditions in this agreement.

FITNESS WAIVER AND RELEASE

AGREEMENT FOR PARTICIPATING IN PERSONAL STRENGTH, FITNESS AND CONDITIONING TRAINING WITH HULLSOME WELLBEING t/a PHAT Disruption ('Provider')

The ‘client’ who has booked into this session via https://phatdisruptionGFbookingsystem.as.me/ is acknowledging and accepting the following:

1.              I agree to abide by the rules of HULLSOME WELLBEING t/a PHAT Disruption. I am responsible for any damage to the equipment which I may cause due to negligence.

2.              I HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge HULLSOME WELLBEING t/a PHAT Disruption, and its agents, employees, officers, directors, affiliates, successors and assigns, coaches, teachers and trustees of and from any and all claims, demands, debts, contracts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by, on the premises, of, or for the benefit of, HULLSOME WELLBEING t/a PHAT Disruption, provided that this waive of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.

3.              I understand that the activities, in which I will participate, are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalf of myself, my heirs, assigns, administrators, executors and next of kin, I waive all claims of damage, injuries and death sustained to me or my property, that I may have against the aforementioned release party to such activities, including claims in tort, contract, equity or otherwise.

4.              I acknowledge, agree and represent that I understand the nature of HULLSOME WELLBEING t/a PHAT Disruption, I AM IN GOOD HEALTH and in PROPER PHYSICAL CONDITION to participate in such activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will IMMEDIATELY DISCONTINUE further participation in the activity.

5.              By this Waiver, I assume any risk, and take full responsibility and waive and of personal injury; death, damage, or loss of personal property, associated with HULLSOME WELLBEING t/a PHAT Disruption, including but not limited to using the facility and its equipment in any manner, form or fashion, and participating and/or engaging in any Group Fitness, Personal Training, Small Group Training or Online Training, event or other related activities on and off the premises.

6.              This WAIVER AND RELEASE contain the entire agreement between parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.

7.              The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of HULLSOME WELLBEING t/a PHAT Disruption, whether by agreement, by operation of law, or otherwise.

8.              I have read, understood and fully agree to the term of this WAIVER AND RELEASE. I understand and confirm that by acknowledging and accepting this WAIVER AND RELEASE via my booking on https://phatdisruptionGFbookingsystem.as.me/ I have given up considerable future legal rights.

TRAINER CLIENT AGREEMENT

7-DAY COOLING OFF PERIOD FOR DIRECT DEBIT CLIENTS

If you change your mind after joining, you have a 7-day cooling off period to cancel your direct debit agreement. This period begins on the start date specified in your agreement.

Cancellations must be made in writing via email within this 7-day period.

If you cancel during the cooling off period, any payments you have made will be refunded, minus the cost of any sessions you attended. A $20 administration fee may also apply.

  

CANCELLATONS AFTER THE 7-DAY COOLING OFF PERIOD

For cancellations made after the 7-day cooling off period, we require 21 days’ written notice to cancel your direct debit agreement. All cancellations must be submitted in writing via email.

The 21-day notice period begins from the date we receive your cancellation email. During this time, you can be assured that our commitment to delivering high-quality training and customer service will remain unchanged, and you will continue to receive the same high standard of coaching throughout your remaining sessions.

GROUP FITNESS PACKAGE ADJUSTMENTS

Downgrading Direct Debit Packages:
An administration fee of $50 may apply when downgrading direct debit membership packages.

Notice Period:
A minimum of 21 days’ notice is required for all membership changes. This period may be reduced at the discretion of the coaching team depending on individual circumstances.

Processing Time:
Please allow up to 48 hours for any adjustments to take effect.

PRICING POLICY

PHAT Disruption reserves the right to review and adjust pricing for their training sessions and related services at any time. Clients will be provided with a minimum of 14 days’ written notice prior to any change in pricing taking effect. Continued participation in your training sessions or related services after the effective date of a price change will constitute acceptance of the new pricing.

AGE POLICY

By participating in a Group Fitness session, I hereby certify that I am 18 years of age or older, and that I have read, understood, and agree to the terms of this document.

Participants under the age of 18 must contact the coach directly to arrange their booking, and written consent from a parent or legal guardian must be obtained prior to participation in any Group Fitness session.


VIDEOGRAPY AND PHOTOGRAPHY

Video and/or photography may be recorded during Group Fitness sessions for promotional purposes, including but not limited to use on the PHAT Disruption website, newsletters, and social media platforms. Clients who do not wish to be filmed or photographed must advise their coach prior to the commencement of the session.

TEMPORARY CLOSURES AND COMPLIMENTARY GROUP FITNESS SESSIONS

Staff Breaks:
From time to time, complimentary group fitness sessions may be offered to make up for gym closures to allow coaches adequate rest.

Charity Involvement:
Coaches may volunteer with charitable organisations, which may occasionally require short-term closures.

Unforeseen Circumstances:
In the event of emergencies or unforeseen events, the gym may need to temporarily pause operations. As a small family-run business, we appreciate your understanding and continued support.

 

GROUP FITNESS SCHEDULE CONSISTENCY

Schedule Stability:
We aim to maintain a consistent group fitness schedule to support your routine and fitness goals.

Subject to Change:
The schedule may change due to instructor availability, seasonal demand, or unforeseen events.

Communication:
All schedule changes will be communicated through our official channels, including the website, social media, and in-gym signage.

WET WEATHER SAFETY PROTOCOL

Alternate Entrance:
During wet weather conditions, clients must use the 2 Buscall Court entrance to access the gym.

Safety Signage:
A "Slippery When Wet" sign will be displayed at the 4 St Amand Street entrance to alert clients of potential hazards.

Client Responsibility:
Clients are expected to follow these safety procedures to ensure their own safety and that of others.
